Orbuno Privacy Policy and Terms of Service
Privacy Policy
Orbuno ("Orbuno", "us" or "we") respects the privacy of users ("you", "member", "Orbiter", "user", "client", "customer", "visitor") accessing our mobile applications ("app", "apps"), website ( orb.uno, "Site"), and our free, premium, survey, coupon, enterprise or other services ("Services"), which include our Site, binary network, APIs, mobile applications, surveys, dashboards, scripts, links, buttons, browser add-ons, plug-ins, widgets, and/or other hardware or software technology.
We know that you care about how your personal information is collected, used and shared, and we take your privacy seriously. Please read the following to learn more about our privacy policy. By using our Services, you are accepting the practices outlined in the Privacy Policy detailed herein.
 
Information Collected by Orbuno
Each user has the option to provide us their recovery email address, name ("User ID"), and password during or after initial use of our Services. Account passwords are recommended and created via cryptographic hash function and can be reset, but not recovered or known by us. Any other personal information gathered by us is done so via voluntary entry by users. We may require additional information for premium and business accounts. Free and Premium users score moods, opinions, emotions and feelings using the Orbuno Orb ("scores"). This data is used only to create your personal rankings, generate psychological insight for your personal use, and create mathematical alignment scores with your Orbiters. We do not share your score data with any 3rd party for any purpose, including ad targeting or tracking. If other Orbiters see any of your score data, it occurs under your full control and discretion as each sharing event you choose to engage in provides granular privacy control. Your data is stored behind multiple layers of sophisticated security, including server hardware and software firewalls, encryption, hashes, and enterprise level cloud server integrated defenses.
 
Non-identifiable use of user data
Orbuno survey, business and enterprise services may use data from visitors who access our services in a non-identifiable manner to associate specific scores, comments, URLs and content with device and IP information, behavioral, demographic, geographic, calendar, and time parameters.  
 
Event information and data integrity
We do not show ads and utilize no form of ad targeting or tracking technology, including Flash cookies, pixels, tags, software development kits, application program interfaces, and Web beacons.
We receive and store certain types of event information whenever you interact with us anonymously as a visitor or as a member. Orbuno automatically receives certain analytical data, markup language and source data from your device or browser which may include your IP address, device ID, geographical information and cookie information. Orbuno uses cookies and event data to help categorize and timestamp the scoring event, preserve your session to prevent multiple login events and, when applicable, obtain urls, titles and images from web pages you score. 

Disclosure of Personal Information
We do not trade, rent, or share your personal and event information, including your name or email address, with third parties.  In only certain cases can your profile or personal information be used without your permission:  Orbuno and authorized consultants and/or contractors may have access to your information if necessary in the normal course of business; Protection of Community, and our Services: We may release personal information when we believe in good faith that release is necessary to comply with relevant laws, subpoenas, or warrants served upon us; to enforce or apply our Terms of Use and other policies; or to protect the rights, property, or safety of our Services, our employees, our community, or others.
Any score information you share with others can potentially be screenshot and shared on social platforms or by other means; Orbuno is not responsible for prevention or control of the ensuing dissemination of said information in this or similar scenarios.  If our company or our assets are acquired by another company, that company will possess the personal information collected by us and it will assume the rights and obligations regarding this information.  You may edit or delete any score and content data you have entered at any time.
 
Information about Children
We do not intentionally gather personal information about Site users who are under the age of 13. Members must be 13 years and older to use our Services. We recommend that minors between the ages of 13 and 18 ask and receive their parents' permission before using our Services or completing any scores.
 
Changes to this privacy policy and email communication
Orbuno may amend this Privacy Policy from time to time, at its sole discretion. If we make changes to privacy policies, we will notify you by posting an alert announcement on the Site or app.  We may also notify you of changes to this or other Site policies, and other information we deem necessary to normally operate, sustain, or enhance the Site and our Services, via the email address provided by you during the signup process.  We will not utilize email communication for the benefit of outside parties or for general solicitation unless authorized by you to do so.  
 
Conditions of Use
If you decide to use our Services, your usage and any possible dispute over privacy is subject to the privacy policy described herein and our Terms of Use.
 
Links to other web pages and websites
The resources, including content, posts, shared links, uploads, web pages and websites that are scored and/or uploaded by users are entirely out of our control and we take no responsibility for them, their content, nor do we endorse these resources in any way. These resources may attempt to send their own data to your hard drive or devoce in the form of cookies to users, collect data, or solicit personal information.  This privacy policy does not apply to the resources we have no control over, do not review, and cannot be responsible for.
 
Safety of your personal information
We use reasonable measures to maintain the security personal information. It is impossible to eliminate all security risks associated with the storage of digital information. Members should protect against unauthorized access to passwords and to your computing device by logging off once you have finished using any said device, especially if it may be a computing device shared by others.

Terms of Service
The following Terms of Service outline your obligations when accessing or using Orbuno (“Orbuno”, “we”, “us”) Services.  You can also review our Privacy Policy, which outlines our obligations and practices towards handling any personal information that you may provide to us.
 
Acceptance of Terms and Use of our Services
Orbuno Services (“Services”) include our binary network, APIs, account types including surveys, coupons, free, premium, enterprise, our mobile applications (“app” or “apps”), web pages (orb.uno, “Site”), scripts, embeds, buttons, plug ins, widgets, website applications, browser extensions, and other products and services for consumers, companies, creators, influencers, brands, publishers, and others.  Our Services are owned and operated by IJudge Opinions, Inc., a California corporation, and are accessed by you under the Terms of Service described herein (“Terms of Service”).
Please read these Terms of Service carefully before using Orbuno or its Services. By accessing our Services, you ("user", "Member", "Orbiter", "Creator", "Publisher", "Agency", "Anonymous user", "Visitor", "client", "customer") agree to become bound by these terms and conditions. If you do not agree to all the terms and conditions, then you may not access our Services, or download our apps, scripts, links, or other products, or use the content of any Services offered. Orbuno’s acceptance is expressly conditioned upon your assent to all these terms and conditions, to the exclusion of all other terms; if these terms and conditions are considered an offer by Orbuno, acceptance is expressly limited to these terms.
 
Availability of our Services
Subject to full compliance with the Terms of Service, Orbuno may offer to provide certain services and content, our Services. Orbuno may change, suspend or discontinue our Services for any reason, at any time, including the availability of any feature or content. Orbuno may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability.
 
Your Membership Obligations
Membership ("accounts") may be granted and revoked at our sole discretion. Most account require user entry of a valid email address, a User ID ("Name", "Username") and a password. Premium and other accounts may require that additional information be provided to begin and/or maintain Membership.  
You may not (i) select or use as a Username or Member ID a name of another person with the intent to impersonate that person; (ii) use a Username subject to any rights of a person other than you without appropriate authorization; or (iii) use a Username that is otherwise offensive, vulgar or obscene. We reserve the right to refuse registration of, or cancel a Username at our discretion; if you select a Username for your account we reserve the right to remove or reclaim it if we believe it infringes upon another’s rights or marks or attempts to impersonate administrator names. You are responsible for maintaining the confidentiality of your Orbuno password.
Users may not create content or scores that may violate the terms herein or damage the intellectual property rights, goodwill, brand image, business pursuits, or reputation of Orbuno or any other organization or person.
Users may access and use our Services as signed in members or as anonymous users ("Anonymous users", "Visitors").  Anonymous users are bound to all Terms of Service described herein and as applicable.  Anonymous uses are identified to us by device ID or IP address and may browse and utilize some of our Services but may not interact directly with Members. Services are available only to individuals who are at least 13 years old, whether acting on their own behalf or as an authorized employee or representative of a corporation or other business entity. If you are under 13 years old, do not attempt to register or use the Services.
 
Your Conduct as a User or Member
As a condition of use, you agree and are hereby obligated not to use our Services for any purpose that is unlawful or prohibited by these Terms of Service, or any other purpose not reasonably intended by Orbuno. We respect other people’s rights and we expect all users to do the same.
In no manner limiting and by way of example only, you agree not to use our Services:
  1. to abuse, harass, threaten, impersonate or intimidate others;
  2. to upload, share, link to, post or transmit any content that is infringing, libelous, defamatory, obscene, pornographic, abusive, offensive, profane, or otherwise violates any law or right of any third party, or content that contains threatening or hateful images or speech of any kind.;
  3. for any illegal or unauthorized purpose. If you are an international user, you agree to comply with all local laws regarding online conduct and acceptable content;
  4. to post or transmit any communication or solicitation designed or intended to obtain password, account, or private information from any Orbuno user;
  5. to create or submit unwanted email (“Spam”) to any other Orbuno users or any URL;
  6. to violate any laws in your jurisdiction (including but not limited to copyright laws);
  7. to submit stories or comments linking to multi-level marketing schemes
  8. you will not use any robot, spider, scraper or other automated means to access our Services for any purpose without our express written permission. Additionally, you agree that you will not: (i) take any action that imposes, or may impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure; (ii) interfere or attempt to interfere with the proper delivery of our Services; or (iii) bypass any measures we may use to prevent or restrict access to our Services;
  9. with the intention of artificially inflating or altering Orbuno survey, coupon or enterprise scores, comments, or any other Orbuno product or service, including by way of creating separate user accounts for the purpose of artificially altering rankings and scores; giving or receiving money or other remuneration in exchange for scores; or participating in any other organized effort that in any way artificially alters the database, results, scores, opinon measurement or other content, product or service of Orbuno;
  10. attempt to impersonate another user or person;
  11. sell or otherwise transfer your Username. In addition, you agree that you will not use our Services on behalf of (or per the request or instruction of) any third party, or pay or otherwise attempt to influence any third party to manipulate or otherwise affect the site in any manner.
Orbuno may remove any content and Orbuno accounts at any time for any reason. You are solely responsible for your interactions with other users of the app or Site. Orbuno reserves the right, but has no obligation, to monitor disputes between you and other users.

Content submitted or made available for inclusion on our Services
By creating and posting shared content to Orbuno you warrant that you own all rights to the content, agree that the content will be dedicated to the public domain under the Creative Commons Public Domain Dedication, available at http://creativecommons.org/publicdomain/zero/1.0/ and that you will not object to the use or distribution of the content by Orbuno or Orbuno users in any context for any time period, even if you subsequently edit or delete said content from appearing in subsequent versions of your account. 
 
Account Beneficiary
Accounts for deceased users will be automatically deleted unless the account contains valid field entries for password, email and beneficiary in the Account Access section of our site. If said conditions exist, and after receipt of said user's email address and death certificate, sent to orbuno1@gmail.com ATTN: Deceased Member, login authorization will be sent to the email address provided in said beneficiary field.
 
Copyright and Infringement Complaints
Orbuno respects the intellectual property of others. It is Orbuno’s policy to respond expeditiously to claims of copyright and other intellectual property infringement. We will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws. Upon receipt of notices complying or substantially complying with the DMCA, Orbuno may act expeditiously to remove or disable access to any material claimed to be infringing or claimed to be the subject of infringing activity and may act expeditiously to remove or disable access to any reference or link to material or activity that is claimed to be infringing. Orbuno will terminate access for subscribers and account holders who are repeat infringers.
Notifying Orbuno of Copyright Infringement: To provide Orbuno notice of an infringement, you must provide a written communication to the attention of “DMCA Infringement Notification Dept.” care of orbuno1@gmail.com;that sets forth the information specified by the DMCA (http://www.copyright.gov/title17/92chap5.html#512). Please note that we may post your notification, with personally identifiable information redacted, to a clearinghouse such as chillingeffects.org. Please also note that you may be liable for damages (including costs and attorneys’ fees) if you materially misrepresent that an activity is infringing your copyright.
Providing Orbuno with Counter-Notification: If you feel that your material does not constitute infringement, you may provide Orbuno with a counter notification by written communication to the attention of “DMCA Counter Notification Dept.” at orbuno1@gmail.com that sets forth all of the necessary information required by the DMCA (http://www.copyright.gov/title17/92chap5.html#512). Please note that you may be liable for damages (including costs and attorneys’ fees) if you materially misrepresent that an activity is not infringing the copyrights of others. If you are uncertain whether an activity constitutes infringement, we recommended seeking advice of an attorney.

B) Patent Notification
Orbuno is the holder of United States patent numbers 8,738,623 and 9,396,271 (Global Reverse Lookup Public Opinion Directory) which protects the Orb and Slider system and method, comprising the presentation of fixed vocabulary words naming specific human values, beliefs, opinions, feelings, moods, emotions, or judgments, grouped as scrollable antonym pairs displayed singularly with pair elements on opposing poles of a graphical sphere, or opposing ends of a slide track, and the generation, storage, forward and reverse lookup utilization of individual and cumulative scores created by said sphere movement.  Unauthorized or unlicensed use of our intellectual property is prohibited.  No user, Orbiter, Member, creator, visitor, publisher, agent, customer or other person, organization or entity may use, copy, transform or implement the Orb or any other Orbuno system, method, or property protected under patent, trademark, copyright, or common law without the expressed written consent of Orbuno. Links and Merchandise
The Services may provide, or third parties may provide, links to other World Wide Web sites or resources. Because Orbuno has no control over such sites and resources, you acknowledge and agree that Orbuno is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that Orbuno shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
Neither Orbuno nor its third party service providers make any warranties with respect to any of the merchandise, products, and/or services featured, mentioned, or sold by others on or through the Site. Transactions for any such item shall be between the user and the third party seller, without any involvement of Orbuno or its third party service providers. You agree that Orbuno and its third party service providers are not responsible, and shall have no liability to you, with respect to merchandise, products, and/or services featured, mentioned, or sold by others on or through the Site, including illegal, offensive or illicit items, or items that violate this Agreement.
 
Indemnity
You will indemnify and hold harmless Orbuno, its parents, subsidiaries, affiliates, customers, vendors, officers and employees from any liability, damage or cost (including reasonable attorneys. fees and cost) from (i) any claim or demand made by any third party due to or arising out of your access to the Site, use of the Services, violation of the Terms of Service by you, or the infringement by you, or any third party using your account or name, of any intellectual property or other right of any person or entity.
 
Warranty Disclaimers
You acknowledge that Orbuno has no control over, and no duty to take any action regarding: which users gain access to or use our Services; what effects the content may have on you; how you may interpret or use the content; or what actions you may take as a result of having been exposed to the content. You release Orbuno from all liability for you having acquired or not acquired content through our Services. Our Services may contain, or direct you to sites or content containing, information that some people may find offensive or inappropriate. Orbuno makes no representations concerning any content contained in or accessed through our Services, and Orbuno will not be responsible or liable for the accuracy, copyright compliance, legality or decency of material contained in or accessed through the Site or the Services. OUR SERVICES AND CONTENT ARE PROVIDED ON AN “AS IS” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
 
Limitation of Liability
In no event shall Orbuno or its suppliers be liable under contract, tort or strict liability, negligence or other legal theory (i) with respect to the Site, the Service or any content for any lost profits or special, indirect, incidental, punitive or consequential damages of any kind whatsoever, substitute goods or services (however arising), or (ii) for any direct damages in excess of (in the aggregate) $100. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations and exclusions may not apply to you.
 
Termination
Orbuno may terminate or suspend any and all Services and your Orbuno account immediately, without prior notice or liability, if Orbuno has a reasonable belief that you may have breached any of the terms or conditions of the Terms of Service. Upon termination of your account, your right to use the Services will immediately cease. If you wish to terminate your Orbuno account, you may simply discontinue using the Services and remove any installed apps, scripts, or other software or hardware that may have been provided to you during your membership period. All provisions of the Terms of Service which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
 
Miscellaneous
No agency, partnership, joint venture, or employment is created as a result of the Terms of Service and you do not have any authority of any kind to bind Orbuno in any respect whatsoever. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder. Orbuno shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Orbuno’s reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation (including “line-noise” interference). If any provision of the Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms of Service shall otherwise remain in full force and effect and enforceable. The Terms of Service is not assignable, transferable or sub-licensable by you except with Orbuno’s prior written consent. Orbuno may transfer, assign or delegate the Terms of Service and its rights and obligations without consent. The Terms of Service shall be governed by and construed in accordance with the laws of the state of California, as if made within California between two residents thereof, and the parties submit to the exclusive jurisdiction of the Superior Court of Ventura County and the United States District Court for the Southern District of California.
 
Modifications of the Terms of Service
We may revise these terms from time to time, and the most current version will be at orb.uno/privacy-TOS. If the revision, at our sole discretion, is considered a material change we will notify you by posting an announcement on the Site. You are responsible for reviewing and becoming familiar with any modifications. Use of the Services after such notification constitutes your acceptance of the terms and conditions of the Terms of Service as modified.
